DEPARTMENTS

The services provided by JP AUCTION MEXICO are governed by these Terms and Conditions of sale. By registering as a bidder you are obligated to comply with these, as well as any additional modification, published and/or publicly announced at the time of the auction. 

The JP AUCTIONS auctions are held in person and online (timed sales).

As a bidder, you can bid:
a) In-person

b) Online

c) Via absentee orders (written form/by mail: contacto@jpauctionsmexico.com)

d) On the phone (pre-registrer)

ABSENT BIDDERS

Fill out the absentee offer form and check the ABSENCE box. 

1. Indicate the lot(s) number you are interested in. 
2. Indicate your maximum bid (bid limit) in Mexican pesos. JP AUCTIONS does not accept bids without limits. 
3. Send your form to contacto@jpauctionsmexico.com at least 2 hours before the auction. 

One of our collaborators could make the offers in your name and representation, without any charge. Please ask us for an acknowledgement of receipt. 

BIDDERS ON THE PHONE

Fill out the absentee offer form and check the ON THE PHONE box. 

1. Indicate the lot(s) number you are interested in.
2. Indicate your phone number and, if it’s possible, a landline number 
3. Send your form to contacto@jpauctionsmexico.com. 

When the lot goes up for auction, one of our collaborators will contact you by phone to allow you to bid against the other bidders in the room. 

ONLINE BIDS

In www.jpauctionsmexico.com, when clicking on the auction, register in “Register to Bid” (Bidsquare Platform*).

1. Create an account to register in the auction as a bidder. 
2. The system will automatically indicate you if your registration was approved.

Bidders registration:

1. All the bidders can pre-register in: www.jpauctionsmexico.com, when clicking on the sale, our platform will invite you to register (REGISTER TO BID). Follow the steps. 
2. The bidders could register from the publication of the catalog and until 2 hours before the auction begins. You must specify if you would like to bid face-to-face, online, in absence, or on the phone. Similarly, you must attach by email all the following documentation, which could be directly presented during the public exhibition if you want to register at the auction venue. 

Individuals:

• A copy of valid official identification 
• A proof of address dated within the last 3 months 
• A copy of the bank statement that includes the CLABE number, account number, branch number and RFC (Federal Taxpayer Registry).

Legal entity:

• A copy of the Company’s Certificate of Incorporation
• A copy of the notarized document proving the legal authority of the legal representative. 
• A Tax Residency Certificate within the last 3 months 
• A copy of the legal representative’s valid official identification 
• A copy of the bank statement that includes the CLABE number, account number, branch number and RFC (Federal Taxpayer Registry).

PARTICIPATION GUARANTEES

1. In order to participate in any of our auctions, the bidder shall leave as a deposit, participation guarantees for the sum established by JP AUCTIONS based on the auction. The guarantees will be “deposited” at the time of the in-person registration.

1. The bidders who decide to deposit guarantees by transfer shall indicate their RFC as a reference, and send the receipt to: facturacionsubastas@gmail.com
2. The bidder who does not purchase any lot will receive a complete refund of the deposit or the transfer made to the sender bank account, the day after the auction. 
3. Bidders may previously examine the goods that are going to be auctioned, during the public exhibition, at the location indicated by JP AUCTIONS.

PARTICIPATION IN THE IN-PERSON AUCTION

1. JP AUCTIONS auction prices are in Mexican pesos and at the exchange rate of the current day. 
2. All bidders must register and provide their participation guarantees.  
3. It will be possible to bid in absent. An absentee bid is the maximum amount offered by a bidder for an item. The auctioneer announces the bid on behalf of the bidder and if the absentee bid is not exceeded by the other bidders, the bidder will be declared the winner of the lot. 
4. All lots in the auction will be awarded to the highest bidder, as long as the reserve price has been achieved and/or exceeded. 
5. The auctioneer reserves the right to reject any bid which it considers deceptive or in bad faith, or which is presumed to be made in the seller’s interest to increase the bidding on their property lot. 
6. The auctioneer may offer in the auction on behalf of third parties. In case of a conflict between two or more bidders, the auctioneer may restart the bidding. 
7. All awards are final and legally binding. No returns of the goods or refunds of the amount paid for them will be permitted. 
8. All goods will be sold in as-is condition, at the location where they are physically situated, and with all their possible defects, imperfections, and alterations. It is the bidder’s responsibility to physically inspect the goods and their documentation during the specified period. 
9. JP AUCTIONS MEXICO does not provide any express or implied warranty, in order to quality, value or condition of the lots. 
10. Each bidder participates in the auction at their own risk and with full knowledge and acceptance of the terms and conditions of sale set forth herein. No claims will be accepted once the lot has been awarded. 
11. If the bidder causes any damage to any of the lots during the public viewing period, they shall be responsible for replacing the lot, paying for the damage, or providing a compensation therefor. 

BID INCREMENT

The auctioneer will determine the increases in bids as indicated below: 

• 1-500                            50
• 500 – 1000                 100
• 1000 – 5000               500
• 5000 – 10 000         1,000
• 10 000 – 50 000      5,000
• 50 000 – 100 000  10,000

BUYER’S PREMIUM

JP AUCTIONS MEXICO will charge a buyer’s premium on each lot awarded. The buyer’s premium will be specified in each catalog under the specific conditions of each sale. 

PAYMENT DEADLINE AND METHODS

1. Full payment of the purchase price or hammer price for the lots acquired must be made no later than two days following the auction. 

JP AUCTIONS MEXICO accepts the following payment methods: 

• Cash, up to a maximum amount of MXN $278,000.00
• Check, subject to collection, payable to JP AUCTIONS MEXICO S.A de C.V.
• Credit card, subject to a 4% surcharge for the use of VISA or MASTERCARD.
• American Express credit card: 5% surcharge.
• Bank transfer.
• Bank deposit made directly at the bank teller.

Please note that in case of winning a lot through the Bidsquare platform, an additional 3% fee will be charged on the hammer price. 

All bank fees and currency exchange fees shall be borne exclusively by the buyer.

1. The payment for the acquired lot(s) must be made to the JP AUCTIONS MEXICO account. 
2. The buyer must pay the total amount due in full prior to the removal of any awarded lot. 
3. In the event that the bidder fails to make full payment within the specified period or fails to comply with any of the terms and conditions, JP AUCTIONS MEXICO shall retain the participation guarantee(s), which shall be deemed liquidated damages (penalty for non-compliance). JP AUCTIONS MEXICO and the seller reserve the right to offer the lot(s) for sale through public and/or private sale. The defaulting purchaser shall be responsible for any resulting deficiency affecting JP AUCTIONS MEXICO and the seller, including expenses incurred in connection with such lot(s). 

BUYER’S DECLARATIONS AND OBLIGATIONS

1. By participating in the auction, each bidder represents, warrants, and agrees to make full payment for all purchases according to the terms set forth herein, representing that they have the legal and financial solvency to comply with their obligations, as well as the financial and legal capacity to place bids. Any bid placed on a lot constitutes an irrevocable offer to purchase. 
2. JP AUCTIONS MEXICO reserves the right to remove lots from the auction before or after the bidding process has taken place, and to modify the order in which the lots are presented in the catalogue. 
3. JP AUCTIONS MEXICO will announce on the day of the auction any addition, modification, removal, or any other circumstance with respect to the lost being auctioned. 
4. The removal of the lots shall be made with responsibility, respecting at all times the guidelines imposed by the venue, the event organizer, and JP AUCTIONS MEXICO for the removal of the goods. 
5. If the buyer fails to remove the awarded goods within the specified period, it will be considered that the buyer has waived them and shall automatically waive all rights relating to such award. 
6. It is the buyer’s responsibility to inform themselves about customs requirements, export licenses, legislation governing the export and import of movable property, import duties, and any other related obligations or expenses. JP AUCTIONS makes no representation or warranty of any kind about the issuance of an export or import license for any lot. 
7. It is the buyer’s responsibility to foresee the packing, shipping, transportation, loading and unloading of the acquired lots. 
8. None of the terms and conditions set forth herein may be negotiated.
